Urgent Product Recall Notice by order of the Federal Court
of Australia
- Single Bunk Bed and Double Bunk Bed
The Federal Court recently made
orders for the publication of this notice following legal proceedings instituted
by the Australian and Competition and Consumer Commission against Aziz
Properties and Services Pty Ltd trading as “Infinity Megastore” (Infinity)
via this internet website, its showroom at 448 Whitehorse Road Mitcham Victoria
and on Ebay's website (http://www.ebay.com.au).
Infinity has supplied to
consumers from April 2007 to October 2008 two bunk bed models, model number 276
being a single bunk bed (Single Bunk
Bed) and model number 277 being a double
bunk bed (Double Bunk Bed).
The Single Bunk Bed and Double
Bunk Beds have been tested for their compliance with the prescribed consumer
product safety standard for bunk beds, namely Australian/New Zealand Standard
AS/NZS 4220:1994 Bunk beds and found not to comply with the design, safety,
performance and marking requirements of this standard. Some of the aspects of
non-compliance of the Single Bunk Beds and the Double Bunk Beds pose
fall-through and entrapment hazards. Accordingly, Infinity has been ordered to
urgently contact customers regarding the Single Bunk Beds and Double Bunk Beds
it supplied between April 2007 and October 2008.
If you have purchased a Single
Bunk Bed and/or Double Bunk Bed from Infinity in the period April 2007 and
October 2008:
(a) make
arrangements for the immediate collection of the Single Bunk Bed and/or
Double Bunk Bed; or
(b) confirm that
you will retain the Single Bunk Bed and/or Double Bunk Bed for the time
being whilst Infinity ascertains whether it can have modifications made
to the bed at your premises that will ensure that the bed complies with
the prescribed consumer product safety standard.
If you wish to take option (b)
set out above, it is imperative that you do not use the Single Bunk Bed and/or
Double Bunk Bed until the bed is modified.
